General Terms and Conditions

1. Scope

These General Terms and Conditions (“Terms”) apply to all purchases made via the website scarnatti.com between Renabed Europe BV (trademark: Scarnatti™, Veldstraat 2, 2930 Brasschaat, Belgium, KVK: 0896.699.573, e-mail: info@scarnatti.com) and the customer (“Buyer”).

The Buyer’s own terms shall not apply; they shall not become part of the contract unless expressly confirmed by us in writing.

2. Conclusion of Contract

The presentation of products on the website does not constitute a binding offer; it merely provides the customer with the opportunity to place an order.

By clicking the “Complete Order” button, the customer makes a binding purchase offer.

Receipt of the order is confirmed by e-mail. This confirmation serves for information purposes only and does not constitute acceptance of the offer; the contract shall only be deemed concluded upon dispatch of the goods or our express written confirmation.

3. Prices and Payment

All prices are stated in euros and include statutory VAT.

Payment methods: most commonly available digital payment methods are accepted. Current information regarding available payment methods can be found in the footer section of the website and on the checkout page.

Payment is collected in advance upon order confirmation.

4. Delivery and Shipping

Deliveries are made within EU member states. For Germany, Belgium, and the Netherlands, the standard delivery time is 1–3 business days; in other countries, delivery times may vary depending on logistics.

Shipping is free of charge for all orders.

Delivery is made exclusively to the customer’s doorstep by an external logistics company; assembly, installation, or delivery to upper floors are not included in the standard service.

5. Retention of Title

The goods shall remain the property of Scarnatti until full payment has been received.

6. Right of Withdrawal (14 Days)

The consumer has the right to withdraw from the contract within 14 days of receiving the goods without giving any reason.

The withdrawal must be declared in writing (by e-mail or letter).

In the event of withdrawal, all payments made shall be refunded via the same payment method once the goods have been received by us.

For hygienic reasons, the statutory right of withdrawal may be restricted in the case of opened and used mattresses; the applicable provisions are subject to the EU Consumer Rights Directive.

7. Additional Return Right – 101 Nights Trial Period

In addition to the statutory 14-day right of withdrawal, Scarnatti™ grants customers a 101-night trial period.

If the customer is not satisfied, a return request may be initiated within this period.

Returns are free of charge; Scarnatti provides a vacuum bag and instructions to facilitate the process.

Returned products will not be resold; they will be recycled or donated.

8. Warranty – 10-Year Limited Warranty

Scarnatti™ provides a limited warranty of 10 years on all mattresses.

The warranty covers manufacturing and material defects, permanent indentations of more than 3 cm in the foam, and workmanship defects.

Excluded from the warranty are: improper use, use of an unsuitable bed base, liquid damage, mold, hygiene issues, and personal comfort preferences.

Mattress covers are covered separately by a 2-year warranty.

For warranty claims, proof of purchase, photographs, and evidence of a suitable bed base may be requested.

A product is only eligible for warranty coverage if it has been used in accordance with the Scarnatti Warranty Terms.

9. Liability

Scarnatti is liable only for damages resulting from intent or gross negligence.

Indirect or incidental damages (e.g., personal dissatisfaction with sleep comfort) are not covered by the warranty or liability.

10. Governing Law and Jurisdiction

These Terms are governed by Belgian law.

Mandatory consumer protection laws of the country in which the consumer resides remain unaffected.

For commercial customers, the exclusive place of jurisdiction is Antwerp (Belgium).

11. Severability Clause

If any provision is found to be invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
